Agreement
These Affiliate Terms of Service govern participation in the Quick Elements Affiliate Program. By applying for, joining, or continuing to participate in the program, you agree to these terms, the Terms of Service, the Acceptable Use Policy, and any program instructions we provide.
We may update the program, commission rules, approved links, creative assets, payout methods, or these terms. Continued participation after updates take effect means you accept the updated terms.
Eligibility and account terms
You must be at least 18 years old, live in the United States unless we approve otherwise, provide accurate legal name, email, tax, and payout information, and maintain only one affiliate account per person or legal entity unless we approve otherwise.
Affiliate accounts must be operated by a real person or business. Automated signups, shared logins, false identities, illegal activity, unauthorized promotions, and attempts to earn commissions from your own Quick Elements accounts are prohibited. You are responsible for all activity under your affiliate account.
Links, codes, and creative assets
We may provide links, codes, banners, graphics, copy, or other approved materials for promoting Quick Elements. You may use those materials only to promote Quick Elements in a truthful, lawful, and brand-safe way. We may change or withdraw materials at any time.
To earn commissions, you must use the special link formats, affiliate codes, or other attribution methods we provide. We are not responsible for lost commissions caused by broken links, mistyped codes, blocked cookies, browser settings, tracking limits, unapproved redirects, or failure to use approved attribution methods.
Commissions and attribution
A sale is commissionable only if our systems attribute it to your approved affiliate link, code, or attribution method and the customer completes an eligible purchase under the program rules in effect at that time. We only pay commissions that are tracked and approved in our systems.
We may reverse, withhold, or disqualify commissions for refunds, chargebacks, cancellations, duplicate accounts, self-referrals, coupon abuse, fraudulent activity, illegal marketing, trademark abuse, misleading claims, overly aggressive tactics, or any violation of these terms.
Payments
Payouts begin after your approved unpaid commissions exceed $50. If your approved unpaid balance has not crossed $50, no payout is due. Once your balance crosses the threshold, we generally pay monthly through the available payout method, subject to review, tax documentation, payment-processor requirements, and fraud checks.
You are responsible for providing accurate tax and payout information and for paying any taxes owed on affiliate income. We may delay or withhold payouts until required information is complete or if we reasonably believe commissions are invalid.
Customers and pricing
Customers referred through the program are Quick Elements customers. Our terms, privacy policies, pricing, checkout rules, support practices, refunds, product availability, and operating procedures apply to those customers. We may change pricing, offers, products, and availability at any time.
Do not publish prices, discounts, guarantees, product claims, or availability unless they are current, accurate, and approved for the promotion you are running.
How you may represent the relationship
You may identify yourself as a Quick Elements affiliate, but you may not say or imply that you are employed by Quick Elements, develop our products, speak for us, are our agent, have authority to bind us, or that we sponsor, endorse, or contribute to a cause unless we have approved that statement in writing.
You may not issue press releases about the program or use Quick Elements trademarks, logos, trade dress, or brand assets except as permitted by our brand guidelines and the materials we provide.
Your responsibilities
You are solely responsible for your websites, emails, ads, social posts, audiences, equipment, tracking implementation, disclosures, privacy notices, content, claims, and compliance. Your promotions must be truthful, not misleading, and appropriate for the audience.
You must clearly disclose your affiliate relationship where required by law or platform rules. You must also maintain a privacy policy or similar notice where you collect visitor data, use advertising pixels, use analytics, send marketing messages, or otherwise track visitors.
Compliance with laws and policies
You must comply with all laws, regulations, rules, platform policies, advertising standards, email laws, privacy laws, intellectual-property laws, and consumer-protection rules that apply to your promotions. This includes CAN-SPAM and other anti-spam laws where applicable.
Do not use spam, purchased lists, deceptive ads, fake reviews, forced clicks, cookie stuffing, adware, malware, typosquatting, trademark bidding, unauthorized coupons, impersonation, misleading domain names, or any method that creates confusion about Quick Elements or the promotion.
Term and termination
Your participation begins when we accept you into the program and ends when either you or Quick Elements terminates it. Either side may terminate participation at any time, with or without cause. Quick Elements may also suspend accounts, deny payouts, or remove affiliates from the program at our discretion.
After termination, you must stop using affiliate links, codes, creative assets, trademarks, and program materials. If we end the program, approved unpaid commissions above the $50 threshold will be paid unless they are invalid, disputed, fraudulent, illegal, or tied to a violation of these terms.
Independent contractor relationship
You and Quick Elements are independent contractors. These terms do not create an employment, partnership, agency, franchise, joint venture, fiduciary, or sales-representative relationship. You have no authority to make promises, warranties, offers, discounts, refunds, or commitments on our behalf.
Disclaimers and limits
The affiliate program and Quick Elements services are provided "as is" and "as available" except where warranties cannot be excluded by law. We do not guarantee that the program, tracking, links, reporting, products, or services will be uninterrupted, error-free, or profitable for you.
To the fullest extent permitted by law, Quick Elements will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages related to the program. Our total liability related to the program is limited to the referral fees paid or payable to you under these affiliate terms.
Disputes
Before filing a claim, the parties will try to resolve affiliate-program disputes informally by contacting legal@quickelements.com. If a dispute cannot be resolved informally, either party may seek relief in the courts allowed by the Terms of Service, except that Quick Elements may seek injunctive or equitable relief for intellectual-property misuse, confidentiality breaches, fraud, security abuse, or misuse of brand assets.
